Terms of Service

NamesWithLove is an AI-powered baby name discovery platform that provides baby name browsing, search, and filtering tools; AI-generated name recommendations and personality insights; compatibility and initials checking tools; baby face prediction using AI image generation; a name pronunciation guide; popularity charts sourced from 145 years of U.S. Social Security data; a baby naming assistant; and premium subscription features.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

By accessing or using NamesWithLove, you confirm that you are at least 18 years of age (or the age of majority in your jurisdiction), have the legal capacity to enter into a binding agreement, and accept these Terms in full. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

• Account registration is handled through Clerk, a third-party authentication provider. You agree to Clerk's terms of service in addition to ours.
• You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
• You agree to provide accurate, current, and complete information during registration and to update it as necessary.
• You must notify us immediately at support@nameswithlove.com if you suspect unauthorized access to your account.
• We reserve the right to suspend or terminate accounts that violate these Terms or that we believe are being used fraudulently.

NamesWithLove offers the following plans:

• Free: Limited access to AI features. Name browsing and search are always free.
• Premium ($9.99/month): Expanded AI chat, name assistant, limited baby face generations, and unlimited favorites.
• Premium Plus ($19.99/month): Unlimited access to all AI features including unlimited baby face generations.

Payments are processed securely by Stripe. By subscribing, you authorize us to charge your payment method on a recurring monthly basis until you cancel. You may cancel at any time through your account dashboard; cancellation takes effect at the end of the current billing period. We do not offer prorated refunds for partial months except where required by applicable law.

We reserve the right to change pricing with 30 days' notice to active subscribers.

NamesWithLove uses Google Gemini and other AI services to generate name recommendations, personality insights, and baby face predictions. By using these features, you acknowledge:

• AI-generated content is for entertainment and informational purposes only. It does not constitute medical, legal, psychological, or professional advice.
• Baby face predictions are AI-generated simulations. They are not accurate predictions of a child's actual appearance and should not be used for any medical or genetic purpose.
• AI outputs may be inaccurate, incomplete, or biased. We make no guarantees about the accuracy or appropriateness of AI-generated content.
• You retain no intellectual property rights over AI outputs generated for you.

When using interactive features (AI chat, name assistant), you agree not to:

• Submit content that is unlawful, harmful, threatening, abusive, or harassing.
• Attempt to extract, reverse-engineer, or misuse our AI systems.
• Use the Service for any commercial purpose without our written consent.
• Upload photos of individuals who have not consented to their image being used for AI processing (e.g., baby face feature).
• Scrape, crawl, or data-mine our platform automatically.
• Circumvent usage limits or access controls.

When you upload photos for the baby face prediction feature:

• You confirm you have the right to upload those photos and consent to AI processing.
• Uploaded images are transmitted to AI providers (Google Gemini) for processing and are not stored permanently on our servers.
• You must not upload photos of children or other individuals without explicit consent.
• Generated baby face images are for personal entertainment only. Commercial use, redistribution, or claims that they represent a real person are prohibited.

The Service integrates with or links to third-party services including:

• Clerk — authentication and user management
• Stripe — payment processing
• Google Gemini — AI name generation and image generation
• Vercel — hosting and infrastructure
• MongoDB Atlas — database services
• TikTok — social sharing and content integration features

When you use social media features (such as sharing content to TikTok or connecting your TikTok account), you are also subject to TikTok's Terms of Service at tiktok.com/legal/terms-of-service. We are not responsible for TikTok's practices or content on their platform.

Your use of third-party services is governed by their respective terms. We are not liable for the actions, content, or practices of any third-party service provider.

All content on NamesWithLove — including but not limited to our name database, AI models, website design, logos, text, graphics, and code — is the intellectual property ofNamesWithLove or its licensors and is protected by copyright and trademark law.

The baby name popularity data is derived from publicly available U.S. Social Security Administration records. AI-generated enrichment content (meanings, origin descriptions, personality traits) is proprietary to NamesWithLove.

You may not reproduce, distribute, modify, or create derivative works from any of our content without express written permission.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our collection and use of data as described in the Privacy Policy.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or harmful components. Name data, AI suggestions, and baby face predictions are provided for entertainment purposes and we make no representations regarding their accuracy.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NAMESWITHLOVE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM OR (B) $100 USD.

You agree to defend, indemnify, and hold harmless NamesWithLove and its affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit to the Service.

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service ceases immediately.

You may delete your account at any time through your account settings. Deletion removes your profile data but does not entitle you to a refund of any subscription fees.

These Terms shall be governed by the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except that either party may seek injunctive relief in a court of competent jurisdiction.

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
